CHAPTER 1. General Provisions and Terms

These general provisions and terms define and govern the legal relations related to the services provided by O₂ Gardens Cafe & Restaurant (hereinafter – Company, We, O₂ Gardens Cafe & Restaurant) through the website (hereinafter – Website).

All information posted on the Website is protected by the copyright legislation of the Republic of Armenia and international agreements and may not be reproduced by anyone in any form without the Company's consent. Photographs, videos, and graphic images bearing the Company's logo are the exclusive property of the Company and are protected by the copyright legislation of the RA and international agreements. Their reproduction without appropriate reference is prohibited.

By accessing the Website, using any services of the Website, or downloading any content in whole or in part, You as a user (hereinafter – User, You, Your, Customer) confirm that you have fully read and understood these terms of use, as well as other terms for the provision of Services by the Company published on the Website (hereinafter – Terms), and unconditionally accept them, regardless of whether You are a customer of the Services provided by the Company, a subscribed user of the Website, or simply a visitor.

The Company reserves the right to unilaterally modify these Terms at any time without prior notice. In case of changes to the Terms, the Company will publish the updated Terms on the Website, indicating the date of the last modification. It is the User's responsibility to periodically visit the Website and check for changes to the Terms. The new terms shall take legal effect and apply to relations arising after their posting on the Website.

If You do not agree with these Terms, please discontinue use of the Website. Being on the Website, subscribing, and using the Services constitute Your unconditional acceptance of these Terms.

CHAPTER 2. Website Subscription Procedure

By agreeing to the Terms, You confirm that You have full legal capacity and the right to use the Services. If You represent a legal entity, You certify that You have all the authority from such legal entity and under the laws of the country where the legal entity is located to use the Services. By agreeing to these terms, You accept that We cannot verify the information and data You provide, or the authenticity of Your representations in this clause, therefore full responsibility for any breach of this clause lies with You.

To use the Services, the Customer must subscribe on the Company's website. To subscribe, the Customer must fill in their email address in the 'Subscribe' section on the Website, through which they wish to receive the Services provided by the Company, and click the 'I Agree' button, thereby giving their consent to accept these general provisions and terms.

CHAPTER 3. Services Provided by the Company and the Procedure for Their Provision

The Company informs its subscribers about new menu items, events, and promotions available on the Website (hereinafter – Services).

Information is provided by sending an email to the email address provided by the Customer, containing the relevant link to the Company's website regarding new menu items, events, and promotions.

No specific frequency for the provision of information by the Company is envisaged; it will be provided when new menu items are available or when there are changes to events, promotions, or other conditions.

To fully use the Services provided by the Company, You must subscribe on the Website. Each customer may subscribe once with one email address. Customers may not use other persons' email addresses. When subscribing, the Customer must provide accurate required information. In any case, the Company shall not be liable for any damage or inconvenience caused to third parties as a result of the Customer providing false or third-party information. The Customer is liable for any damage caused to the Company or third parties by such actions.

The Company reserves the right to unilaterally refuse to provide Services to the Customer if it is established from any reliable source that the information provided by the Customer is false, unreliable, or belongs to other persons.

The Company is liable only to its Customers for the provision of unreliable or untimely information.

CHAPTER 4. Privacy

You may visit the Website without registering; however, to fully use the services of the Website and the Company, You must subscribe on the Website. Personal information is collected (obtained) only when You provide it. When subscribing, You must provide Your email address. At the time of Your subscription, we receive the email address You provide. The Company may also obtain additional information about You through complaints from other customers, our service center, or other sources of information.

The Company takes appropriate electronic, physical, and other security measures to protect Your personal information from unauthorized access, alteration, or disclosure. The data You provide is stored in a secure server database. The Company will never ask You to provide any other personal data by phone or email. Your personal data will not be disclosed to third parties without Your consent, except in cases provided by law (requests from law enforcement and state bodies within their competence, court requests, etc.). Your data may be made available only to persons affiliated with us when such data is necessary for the provision of services to You and for improving their quality. We cooperate with other organizations and/or individuals for the proper provision of Services to You.

CHAPTER 5. Subscription Cancellation

You have the right to cancel Your subscription on the Website at any time by clicking the 'Cancel Subscription' button or by any other method provided by us.

Cancellation of subscription by the Customer releases the Company from the obligation to provide information to the Customer. The Customer understands and accepts that after cancellation of subscription they will not receive emails regarding new menu items, events, and promotions on the Website.

The Company has the right to unilaterally terminate the Customer's subscription if the Customer violates these Terms or other terms of use.

After cancellation of subscription, the Customer's personal data will be retained in the Company's database only for the period and in the manner prescribed by law.
